Terms of Service

These terms of service applies to the Ami.ai app (hereby referred to as "Application") for mobile devices that was created by Ami.ai Developer (hereby referred to as "Service Provider") as a Commercial service.

By downloading or using the Application, you agree to these terms. Unauthorized copying, modification of the Application, or our trademarks is prohibited. All intellectual property rights remain the property of the Service Provider.

When you download the Application through different app stores:

1. Apple App Store

• "Store Provider" refers to Apple Inc. and its affiliates
• The agreement is between you and Ami.ai Developer only, not with Apple
• Ami.ai Developer, not Apple, is solely responsible for the Application and its content

2. Google Play Store

• "Store Provider" refers to Google LLC and its affiliates
• The agreement is between you and Ami.ai Developer only, not with Google
• Ami.ai Developer, not Google, is solely responsible for the Application and its content

The term "Store Provider" in this agreement refers to either Apple or Google, depending on which platform you downloaded the Application from.

Throughout these Terms of Service:

• "Application" refers to the Ami.ai app
• "Service Provider" refers to Ami.ai Developer
• "You" refers to the individual accessing or using the Application
• "Service" refers to the Application and any related services provided
• "Store Provider" refers to the platform through which you downloaded the Application

By downloading and using the Application, you acknowledge:

• The license granted is non-transferable and limited to devices you own or control
• You may access the Application through Family Sharing or volume purchasing according to the respective Store Provider's terms
• Store Provider (Apple/Google) has no responsibility for the Application and its content
• All maintenance and support is solely provided by Ami.ai Developer
• You must comply with applicable third-party terms when using the Application (e.g., wireless data service agreements for VoIP features)

The Application offers subscription-based services. By subscribing to the service:

• Your subscription will automatically renew unless auto-renewal is disabled
• Refunds for subscription fees are handled according to the respective app store's policies
• Price changes will be notified in advance

You agree not to use the Application for:

• Any illegal purposes or to conduct unlawful activities
• Attempting to gain unauthorized access to the Application's systems
• Interfering with or disrupting the integrity of the Application
• Sending automated queries to the system
• Collecting user information without consent
• Distributing malware or other malicious code

The Service Provider reserves the right to modify or discontinue the Application at any time. Any changes to the pricing or significant features will be communicated in advance.

Your use of the Application is governed by our Privacy Policy, which details how we collect, use, and protect your personal information in compliance with GDPR and other applicable data protection laws. Please refer to our Privacy Policy for complete information about our data practices.

The Application utilizes third-party services that have their own Terms of Service. You acknowledge that your use of such third-party services is subject to their respective terms and privacy policies.

You must be at least 9 years old to use the Application. If you are between 9 and 16 years old and located in the EEA, you need parental consent.

• You are responsible for maintaining the confidentiality of your account credentials
• You must provide accurate and complete information when creating an account
• The Service Provider reserves the right to terminate accounts that violate these Terms

• We will make reasonable efforts to resolve any disputes through amicable negotiation
• If negotiation fails, disputes will be resolved under Japanese law
• For EEA users, this does not affect your statutory rights

Regarding the Application:

• It is provided "AS IS" without warranty of any kind
• If the Application fails to conform to any warranty, you may notify the Store Provider for a refund of the purchase price
• Beyond the refund, Store Provider shall have no other warranty obligation
• All product liability claims, legal/regulatory compliance issues, and intellectual property claims will be handled solely by Ami.ai Developer
• For EEA users, these limitations do not affect your statutory rights under GDPR and applicable consumer protection laws

Users can terminate their account and delete their data through:

• The Application settings (for account and data deletion)
• Cancelling any active subscriptions through their app store account
• Alternatively, contacting us at amiaispace@gmail.com for assistance

You acknowledge and agree that:

1. For Apple App Store users:

• Apple and its subsidiaries are third-party beneficiaries of this Agreement
• Upon acceptance, Apple has the right to enforce this Agreement against you as a third-party beneficiary

2. For Google Play Store users:

• Google and its subsidiaries are third-party beneficiaries of this Agreement
• Upon acceptance, Google has the right to enforce this Agreement against you as a third-party beneficiary

The Service Provider may update or terminate the Application at any time. You agree to accept updates when offered. Upon termination: (a) your rights and licenses will end; (b) you must cease using and delete the Application.

You retain ownership of your Content but grant us a license to use it for providing the Service. Report copyright violations to: amiaispace@gmail.com

You represent and warrant that:

1. You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country
2. You are not listed on any U.S. Government list of prohibited or restricted parties
3. You will comply with all applicable international and national laws, including:
   • U.S. Export Administration Regulations
   • End-user, end-use, and destination restrictions
   • Sanctions and embargoes

The Application may not be exported or re-exported to:

• Any country embargoed by the United States
• Anyone on the U.S. Treasury Department's list of Specially Designated Nationals
• Anyone on the U.S. Department of Commerce Denied Person's List or Entity List

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

These Terms constitute the entire agreement between you and the Service Provider regarding your use of the Application and supersede all prior and contemporaneous written or oral agreements between you and the Service Provider.

The Service Provider may update these Terms at any time. Any significant changes will be notified through the Application or email. Continued use after changes constitutes acceptance of the new Terms.
